MUSCAT Omans new Labour Law gives the employer the right to fire a worker without notice and end-of-service gratuity if he commits certain kinds of offences such as divulging secrets related to work, staying away from workplace without a valid reason and misbehaving while on duty, a government-run newspaper reported on Tuesday.
The Oman Daily Observer quoting a senior Manpower Ministry official, said the new law attached considerable attention to the duties of workers with the emphasis on discipline and boosting productivity.
Workers have to carry out the orders given by the employer, or his representatives, as long as the orders are pertaining to the tasks involved in the job and agreed upon in the labour contract the paper quoted Mohammed bin Ahmed Al Rajah, Deputy Director-General of Workers Welfare, as saying.
The worker has the right to disobey any order that contradicts the conditions of the labour contract, or contravenes with the binding provisions of the Labour Law. The worker also has the right to reject any command that puts his life at risk, he added.
The employee must report for work and leave it as per the stipulated times, Rajah said, adding: Any violation on the part of the worker regarding the work timing will hold the worker responsible and expose him to punitive measures in accordance with the provisions of the law. The employer is allowed to deduct a days wage from the workers salary for absence.
The law, he said, also gave the employer the right to dismiss a worker in case of absence from work for more than seven consecutive days without giving convincing excuse or 10 non-consecutive days during the year.
The worker should be given a written notice prior to the dismissal.
He said according to the new law the employer has no right to force workers to carry out a task when they refuse to do it.
In such cases the employer has the right to terminate the labour contract and demand compensation for the loss caused by the workers refusal to carry out his duty, he added
